Dealer Privacy Policy regarding Personal Information*
We
are committed to customer service and integrity and endeavour
to protect the privacy and security of customers’ personal
information. For purposes of this policy, “we”,
“us” and similar terms mean your local independently
owned and operated associate dealer of Tirecraft Auto Centers
Ltd.
Our
commitment to your privacy is described below and outlines:
• what personal information is;
• what personal information we collect;
• how we use and disclose your personal information;
• how we ensure the security of your personal information;
and
• your rights regarding your personal information that
we hold.
This
policy and our practices have been developed to incorporate
the requirements of the Personal Information Protection
and Electronic Documents Act (PIPEDA) and similar
applicable provincial privacy legislation and have incorporated
the ten principles set out in the Canadian Standards Association
(CSA) Model Code for the Protection of Personal Information.
This
Privacy Policy has been customized to reflect our business
and our customers’ specific privacy issues and is intended
to evidence and describe our commitment to the protection
of personal information. This Privacy Policy does not apply
to information regarding our corporate customers (but which
may be protected by other policies and procedures) or to information
which is non-identifying.
The
Tirecraft Group
In
order to offer you a wide-range of products and services in
a multitude of locations, Tirecraft Auto Centers Ltd. (“TACL”),
has a number wholly and partially owned subsidiaries, affiliates,
including Remington Tire Distributors Inc., and a network
of other associate dealers. As part of the Tirecraft associate
dealer system, we collect from and share with this Tirecraft
group your personal information. In turn, these group members
may use and disclose this shared personal information in the

What
is personal information?
Personal
information is information about, which refers to or can be
linked to an individual’s identity, regardless of the
form or medium in which it is recorded or stored, but does
not include certain business contact information. Examples

surveys, and in connection with polls or contests, including
your name, address and e-mail address;
• in connection with billing and payment
purposes, credit or debit card information, such as card number
and card expiration date;
• information on applications for credit
such as social insurance number, date of birth, credit history,
credit references and similar information; and
• information that is publicly available
and permitted by law to be collected without consent.
Why
do we collect your personal information (how do we use it)?
We
collect and use your personal information for the following
purposes:
• to establish and maintain relationships
with you and provide products and services to you. When you
wish to purchase products and/or services from us, we collect
information in order to provide the appropriate and best products
and services;
• to manage our business and operations
so that we can effectively and efficiently provide and improve
our business and product and service offerings to you. We
use this information to analyze our customer’s preferences
and improve our products and services, to alert you to new
developments or promotions and to fulfill our associate dealer
obligations to TACL;
• for billing and credit purposes.
We may need to collect credit card or other payment information
in order to process your account or payment. We may also need
further information in order to grant and manage credit;
• from TACL, information from your
use of the www.tirecraft.com Web site, such as navigation
patterns at the site and information collected through Internet
cookies (cookies are messages linked to your Internet browser
and used to customize your experience at the www.tirecraft.com
Web site by, for example, showing you only information that
is relevant to your interests); and
• those which are required for us to
meet our legal obligations.
When and why do we disclose your personal information?
We never sell or trade your personal information and we only
disclose your personal information outside of our organization
or the Tirecraft group (described above) in limited circumstances
as described below:
• disclosure of personal information
to persons or companies employed or retained by us or by other
members of the Tirecraft group to perform certain services
or functions on our or the Tirecraft group’s behalf,
such as billing, debt collection, marketing/advertising or
research services. In cases where we utilize these persons
or companies, we restrict their use of your personal information
to the purpose for which it is shared (i.e. what is necessary
to act on our behalf for those specific purposes) and require
that these parties contractually agree to ensure the privacy
of your personal information to the same extent that the Tirecraft
group does;
• disclosure of personal information
to third parties with your consent or as required or permitted
by law. These disclosures may include, among other things,
disclosures to effect or process loans or other products or
services that you request, to our affiliates or within the
Tirecraft group to provide a product or service you have requested,
to process credit card transactions, to permit auditing of
account information, to comply with legal process, such as
a subpoena, search warrant, or other court or government agency
order, or in the event of a sale or transfer of our business
or assets;
• in cases where you apply for credit,
within the Tirecraft group and to agents or credit reporting
agencies/bureaus for the purpose of evaluating and reporting
on your creditworthiness and credit history; and
• disclosure of aggregated information
that does not identify you individually but which is compiled
using your personal information.
How do we protect your personal information
and how long do we retain it?
The only employees who have access to your personal information
are those who require it in order to provide you with the
products and services you have requested. We also utilize
physical and electronic measures to safeguard your information
from outside parties, including password protection, data
management practices, locked file cabinets and other measures
to restrict access to the data we hold in physical and electronic
forms.
We don’t retain your personal information indefinitely,
instead, we only keep it for as long as necessary or relevant
for the purposes described above or as required by law.
Your rights and choices.
The foundation of our commitment to protecting your privacy
is your consent. Except as permitted by law, we need your
consent to continue to collect, use and disclose your personal
information for the purposes identified above. However, you
do have choices and can withdraw or refuse to provide your
consent, subject to reasonable notice and legal and contractual
obligations between us. In addition, while we will never require,
as a condition of supplying a product or service, you to consent
to the collection, use or disclosure of personal information
beyond what is necessary to provide the product or service,
however, certain refusals or withdrawals of consent may impede
our ability to serve you.
If you have provided us with consent and do not contact us
to the contrary, we will assume that we may continue to collect,
use and disclose your personal information in accordance with
the consent that you have given us and with this policy.
In addition to your right to refuse or withdraw your consent
and our obligation to maintain the security of your information,
you have rights to access the personal information we hold
about you and to request correction to that information if
it is incomplete or incorrect.
You may, through the contact information below, request access
to your personal information and, if required, to correct
it. We are required to and will provide access to your information,
except where we prohibited by law from doing so, or are permitted
by law to restrict your access and have legitimate business
or legal reasons for doing so. In certain cases, we may be
permitted to charge certain fees for providing access and/or
